Quentin Cregan spoke at the Midlands Intellectual Property Society (MIPS) event on Thursday 7th July 2016. His talk, entitlted '(De-?)Europeanising IP Enforcement' considered the interaction between the UK's domestic IP remedies and enforcement regime, in the context of both EU Marleasing and international Jade obligations. In particular, his talk focused on the effect of EU and international law on damages, costs, and injunctive remedies paying particular regard to approach domestic courts have taken in Absolute Lofts, HTC v Nokia, and Cartier v. BSkyB (including the recent Court of Appeal judgment). His talk concluded by taking into account possible post-Brexit scenarios for the IP enforcement regime in the United Kingdom, looking particularly at the possibility of EEA and EFTA engagement.
