Year of call: 2016

Michael Conway joined 8 New Square as a member of chambers in 2017. During his pupillage year he assisted with the full range of intellectual property matters, including a number of major patent actions as well as design right, trade mark and copyright cases.

Michael has a background in molecular biology and genetics, having obtained a degree in molecular and cellular biochemistry from Oxford followed by a PhD: “Improving genetic approaches to mosquito population control” from Oxford. Prior to his PhD he was a senior research fellow at the Russell Group of Universities – a think-tank and strategy group representing leading UK universities.

Michael is currently instructed, along with two senior members of chambers, on a major biotech action expected to reach trial in 2018.

Silence Therapeutics v Alnylam – Instructed as junior counsel alongside Daniel Alexander QC, Mark Chacksfield and Isabel Jamal, and appeared alongside Mark Chacksfield at the CMC in this ongoing patent action concerning RNAi therapeutics.

British Broadcasting Company v PRS – Instructed as junior counsel on behalf of Sky UK Ltd (intervener) in a dispute before the Copyright Tribunal: appeared as sole counsel at the CMC with Martin Howe QC in a preliminary hearing concerning the Tribunal’s jurisdiction.

Regen Lab SA v Estar Medical Ltd – Instructed as junior counsel with Andrew Lykiardopoulos QC in an ongoing patent action concerning a method of blood plasma preparation.

Revital v Royal Voluntary Service – Instructed as junior counsel with James Mellor QC in a Trade Mark revocation action at the IPO.

H&F Upholstery v AJ Produktor – Instructed as sole counsel in an ongoing Trade Mark opposition at the IPO.

Core Wireless v Huawei – Instructed as junior counsel alongside Adrian Speck QC, Isabel Jamal and Tom Jones, to assist in preparing evidence for a hearing on jurisdiction in an action concerning FRAND licences for mobile phone patents.

TEVA v Novartis – Instructed as a junior counsel alongside Charlotte May QC and Mark Chacksfield, to assist in preparation of expert evidence in a patent action which settled out of court.

I have also been solely instructed to prepare a number of opinions and pleadings on matters relating to trade marks, copyright and passing off.

Positec Power Tools (Europe) Ltd v Husqvarna AB – assisted in preparation for trial and attended at CMC and PTRs in this patent action concerning electronic lawnmowers, which settled out of court.

Varian Medical Systems International AG v Elekta Ltd [2017] EWHC 712 (Pat) – attended a PTR and hearing on disclosure and assisted in preparing for trial in a patent action concerning combined MRI imaging and radiotherapy.

Fujifilm Kyowa Kirin Biologics Co Ltd v Abbvie Biotechnology Ltd [2017] EWCA Civ 1; [2016] EWHC 3383 (Ch) – assisted pupil supervisor in preparing for and attended a hearing at the Court of Appeal concerning, amongst other things, the nature and scope of the court’s jurisdiction to grant declaratory relief in patent disputes.

Liqwd Inc v L’Oreal (UK) Ltd - assisted in preparation of pleadings, legal research and disclosure review in a patent infringement action.

Regeneron Pharmaceuticals Inc v Kymab Ltd – assisted in drafting the skeleton argument for an appeal in a patent action concerning transgenic mice.

Spin Master Ltd v PMS International Group [2017] EWHC 1477 (Pat) – assisted in preparing for and attended the CMC of this action concerning a registered design for a childrens’ toy.
