Patents and SPCs:

Actavis v Eli Lilly [2013] EWHC 3749 (Pat):
Isabel represented Actavis in this dispute relating to the appropriateness of granting Actavis declarations of non-infringement. The UK Court has jurisdiction to decide this question for the French, Spanish and Italian designations of the Patent as well as the UK designation. The case relates to the correct construction of the term ‘pemetrexed disodium’ (including whether it encompasses other pharmaceutically acceptable salts of pemetrexed under the doctrine of equivalence), and the law applicable to claims for declarations of non-infringement under the Rome II regulation (judgment). The Court of Appeal judgment is pending.

Actavis v Boehringer C-577/13:
Isabel was junior counsel for Actavis at the CJEU hearing regarding the validity of Boehringer’s SPC. Actavis revoked Boehringer’s SPC based on the meaning and effect of the SPC Regulation
(judgment of CJEU).

Vringo v ZTE [2014] EWHC 3924 (Pat):
Isabel appeared as junior counsel for ZTE in this patent validity and infringement action. The case is currently progressing to a trial on the appropriate relief to be granted to Vringo (in terms of a FRAND royalty rate).

Unwired Planet v Huawei, Samsung and others:
Isabel represents Unwired Planet in this ongoing telecoms dispute. Isabel is involved in both the technical patent trials and in the competition law/FRAND trial which is due to be heard in October 2016.

Actavis v Eli Lilly HP-2014-000027:
Isabel is junior counsel for Actavis in this patent revocation action. The patent relates to the use of Atomoxetine for the treatment of ADHD.

EMGS v PGS:
Isabel represents EMGS in this patent validity and infringement dispute. EMGS’s patent relates to the use of electromagnetics in the context of oil and gas exploration.

ViiV v Teva:
Isabel represented ViiV in this dispute about the validity of ViiV’s SPC for the combination of abacavir and lamivudine. The case turned on the correct meaning and effect of the SPC Regulation. The dispute settled before trial.

Merck v Sigma:
Isabel appeared as junior counsel for the defendant in the High Court, at the CJEU and in the Court of Appeal in this patent case concerning parallel imports of pharmaceutical products from the Member States which acceded to the EU in 2004 and the interpretation of the specific mechanism provision in the Act of Accession (judgment of the CJEU).

Regeneron v Genentech:
Isabel acted as junior counsel for the successful patentee (defendant) at first instance and in the Court of Appeal in this infringement and validity action relating to its patent for therapeutic agents for the treatment of excessive angiogenesis the Court of Appeal (judgment of the Court of Appeal).

Trade marks:

IPC Media v Media 10:
Isabel was junior counsel for IPC Media in a trade mark dispute relating to the use of the trade mark “IDEAL HOME” for online retail services.

Evegate Publishing v Newsquest:
Isabel represented Newsquest in a trade mark and passing off action concerning newspaper and magazine titles.

Weight Watchers (UK) Ltd v Love Bites Ltd:
Isabel represented Weight Watchers in the Patents County Court in this trade mark infringement and passing off dispute (judgment).

Design rights:

Alfrank v Exclusive [2015] EWHC 1372 (IPEC):
Isabel represented Exclusive in this damages inquiry relating to the appropriate damages to be awarded to Alfrank for unregistered design right infringement. Alfrank’s claim for lost profit due to lost sales was partially rejected; the Court held that Alfrank was entitled to lost profit for 20% of Exclusive’s sales of infringing products (judgment).

Ifejika v Ifejika (PCC):
Isabel represented the defendant in this design right trial in the Patents County Court, in which her client was successful in his counterclaim to invalidate the Claimant’s registered design (judgment).

Patents:

Lizzanno Partitions (UK) Limited v Interiors Manufacturing Limited (IPEC):
Isabel represented the defendant in this patent trial regarding both the infringement and validity of a patent concerning gaskets used in the partitioning industry (judgment).

 

Isabel has a first class Masters degree in Physics and Philosophy from Oxford University and received several major scholarships during her degree, her law conversion course and bar vocational course. Isabel is a strong advocate and a prize-winning public speaker, having competed both at a regional and European level.
