Case Summary | Judgment | 19 March 2010
This was a claim by Mr Kerr against his former patent agents, whom were represented by Mark Chacksfield, in which the Claimant alleged that he should have obtained valuable patent rights in Canada. The trial covered a huge range of issues, from the scope of the retainer, breach, causation and damage, and included expert evidence as to Canadian patent law and procedure. Ultimately the Court held the evidence of the Claimant to have been most unreliable, and dismissed the action in its entirety.
