Five members of 8 New Square appeared in this 3 week High Court before Asplin J.
Richard Meade QC, Adrian Speck QC, James Abrahams, Iona Berkeley and Elspeth Talbot Rice QC were for the IKOS parties instructed by Herbert Smith Freehills LLP. This High Court action involved a dispute as to the ownership of the intellectual property rights in certain software used by the financial investment business, IKOS.
The case also concerned a claim for copyright infringement and breach of confidence. The intellectual property rights ownership dispute involved matters of partnership law. The case also involved detailed issues concerning the authorship of the software in issue. The three week High Court trial was heard in March 2013 before Asplin J. Judgment was handed down on 22 May 2013. The Judge found for the IKOS parties, finding that the intellectual property rights in the software in issue were owned by the IKOS parties and that Dr Coward was liable for copyright infringement and breach of confidence. Ashton Chantrielle of 8 New Square appearing with 4 other Counsel, instructed by Lewis Silkin LLP, were for Dr Coward.
