Henry Ward  recently appeared with Roger Wyand QC for Lonsdale Sports Limited, the well-known sporting goods company. Lonsdale successfully appealed the decision of the Trade Mark Registry to register the respondent’s mark.

Lonsdale had opposed registration on various grounds, including that the respondent’s mark took unfair advantage or was detrimental to the distinctive character or repute of Lonsdale’s.

Finding for Lonsdale, Norris J held that the Hearing Officer had failed in a number of respects to properly apply the law, and should have held that the applicant’s mark took unfair advantage of the Lonsdale marks and so was not registerable.
