Adrian Speck appeared with Richard Spearman QC for the members of the Motion Picture Association at a hearing before Mr Justice Arnold in which the MPA successfully obtained a novel order against BT under s. 97A CDPA. The order prevents BT’s customers from visiting the Newzbin webpage, which makes available pirate versions of films, TV and other content such as music.
The hearing followed a trial in 2010 at which Adrian appeared for MPA against Newzbin and obtained an Order requiring Newzbin to cease its infringing activities. Newzbin re-emerged with servers out of the jurisdiction and this latest application seeks to find a novel way of preventing Newzbin from infringing the MPA's IP rights.
